For some people on sick leave, the temptation to sneak to the pub for a crafty drink is too great to resist. Now, a judge’s ruling suggests they needn’t fear being spotted.

An employment tribunal in Newcastle has been told that staff on sick leave are entitled to visit their local.

Judge Andrea Pitt ruled that an employee was unfairly dismissed after he was seen drinking at a social club while on sick leave. Colin Kane, a driver for a company that lays tarmac, is now in line to receive damages.

Kane, 66, called in sick one morning in March last year and was sacked after a colleague reported seeing him drinking and smoking in the afternoon.
